1. Scope and Definitions
These general terms and conditions apply to all quotes, assignments, and agreements provided by Loket 285.
- Client: Any professional natural or legal person (B2B) entrusting an assignment to Loket 285.
- Dossier: The collection of administrative, technical, and content-related documents required for submission to the competent authority (digital or physical, depending on the region).
- Architectural Requirement: Loket 285 exclusively provides services for dossiers for which no architect is legally required.
2. Responsibility and Existing Situation
- Duty of Information: The client is responsible for the accuracy and completeness of all provided data (measurements, photos, technical sheets).
- Legal Basis: The client guarantees that the existing situation of the building fully corresponds with the last permitted state. Loket 285 does not have access to permit history due to privacy legislation; verification thereof is the exclusive responsibility of the owner/client.
- Building Violations: Loket 285 does not perform regularizations. If it appears during the procedure that the existing situation is non-compliant, Loket 285 reserves the right to immediately suspend the assignment without any refund of fees already paid.
3. Specific Obligations (Lease, Ownership, and Wallonia)
- Proof of Ownership (Brussels & Wallonia): For leased properties, the client is required to provide written owner consent as well as a formal extract of the title deed (proof of ownership). Without these documents, Loket 285 will not initiate the procedure.
- Paper-based Workflow (Wallonia): The client acknowledges that physical submission is required for dossiers in the Walloon Region. Administrative delays caused by postal services or manual processing by the authority are beyond the responsibility of Loket 285.
- Affichement (Public Notice): The client is responsible for the physical posting of the official notice (public inquiry) and the immediate notification of the posting date to Loket 285.
4. Rates, Payment Terms, and Volume
- Rates: Services are invoiced according to the rates mentioned on the website or in the specific quote. All prices are exclusive of VAT.
- Volume Agreements: Volume discounts are valid for a period of 12 months or the duration of a specific project. If the projected volume is not achieved, Loket 285 reserves the right to retroactively invoice the regular rates.
- Payment Modality (Pre-payment): Loket 285 operates exclusively on a pre-payment basis. The invoice is sent following the dossier intake. The internal processing time commences only after receipt of full payment in the bank account of Loket 285.
- Payment Term: 7 calendar days. In case of non-payment, interest (10% per annum) and a fixed compensation fee (10%, min. € 125) are due by law.
5. Intellectual Property
- All plans, notes, and designs prepared by Loket 285 remain the property of Loket 285 until full payment is received.
- Loket 285 reserves the right to use completed projects anonymously for commercial promotion and portfolio purposes, unless expressly agreed otherwise in writing.
6. Lead Times, Results, and Force Majeure
- Internal Deadline: Maximum 10 working days after receipt of the complete dossier and payment.
- Authorities: Loket 285 is not liable for delays caused by public authorities or the unavailability of digital submission platforms.
- No Guarantee: Loket 285 commits to an obligation of means, not result. Refusals based on local policy or aesthetic criteria do not entitle the client to a refund.
- Force Majeure: In case of force majeure (illness, technical failures beyond control), deadlines are suspended without any right to compensation for the client.
7. Duration and Termination
- Termination Method: The client may terminate the assignment at any time. This termination must occur exclusively in writing (via email). Fees already invoiced remain due.
- Inactivity: If the client fails to provide the required information or payments within a period of 30 calendar days, Loket 285 has the right to unilaterally terminate the assignment. Any subsequent restart will be invoiced as a new assignment.
8. Liability, Law, and Jurisdiction
- Liability is limited to the invoice amount of the specific assignment. Indirect damages (loss of turnover, delayed openings) are excluded.
- Belgian law applies. The courts of the judicial district of Mechelen have exclusive jurisdiction.
